Terms and Conditions

Welcome to Hereditas! These Terms of Service ("Terms") constitute a legally binding End User License Agreement (EULA) between you and Hereditas ("we," "us," or "our"), governing your access to and use of the Hereditas mobile application ("App") and all associated services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility and Acceptance

You must be at least 13 years old to use Hereditas. By using the App, you confirm that you are eligible and that you agree to comply with these Terms and all applicable laws.

2. Description of the Service

Hereditas is an educational mobile app that uses AI to recognize and explain artworks, monuments, and cultural sites based on user-uploaded photos. Users can explore historical facts and curiosities, and store their discoveries within a personal profile. Features vary by tier:

Free Tier: Up to 3 scans per day; limited Learn section content; identification with one curiosity per scan; no chatbot access; limited profile history and organizational features.
Pro Tier (€28.99 or $34.99/year): Unlimited scans; immersive historical explanations; access to follow-up chatbot; full Learn section access; complete profile discovery history and organization tools.

No guarantees are made about the accuracy of identification or information provided. The App is for personal, non-commercial use only.

3. User Accounts

Users may create accounts using email/password or Google/Apple login. You are responsible for maintaining the security of your login credentials and account activity.

4. User Content

You retain ownership of photos you upload. By uploading, you grant us a worldwide, non-exclusive license to use the content solely to provide and improve the App. Photos are stored with your profile, along with the exact location where they were taken.

You agree not to upload photos you do not have rights to or that are illegal, offensive, or infringe on others' rights. We may remove any content that violates these Terms.

Users may be able to share their discoveries publicly within or outside the App. Any such sharing is done at your own discretion and risk.

5. Payments and Subscriptions

Hereditas is free to use with limited features. The Pro version is a paid subscription available for €28.99 or $34.99 annually (depending on region). Payment is processed via the App Store.

Subscriptions auto-renew unless cancelled at least 24 hours before renewal. You can manage or cancel subscriptions via your App Store account. Fees are non-refundable, except as required by law.

If a free trial is offered, it lasts 3 days and may convert to a paid subscription unless cancelled at least 24 hours before the end of the trial. Unused portions of free trials are forfeited upon upgrade.

We may change pricing or features at any time with prior notice.

6. Acceptable Use and Prohibited Conduct

You agree not to:

Use Hereditas for any unlawful, harmful, or commercial purpose.
Upload content that is illegal, infringing, offensive, or harmful.
Use scripts, bots, scraping tools, or other automated systems.
Attempt to bypass usage limits (e.g., scan limits).
Impersonate others or misrepresent your identity.
Distribute malware, spyware, or other malicious code.

Violations may result in suspension or termination of your account.

7. Intellectual Property and License

All rights in the App, including its design, software, text, illustrations, logos, layout, sounds, and source code, are owned by us or our licensors. All elements of the App—including but not limited to the interface, layout, text, images, illustrations, logos, sounds, and source code—are protected by copyright and trademark laws. You may not copy, reproduce, retransmit, distribute, or publish any part of the App without our express written consent.

You are granted a limited, revocable, non-exclusive, non-transferable license to use Hereditas for personal use only. You may not reverse engineer, decompile, copy, modify, rent, sell, sublicense, or distribute any portion of the App or its content.

8. Disclaimers

Hereditas is provided "as is" and "as available." We do not guarantee that:

The information is accurate, complete, or reliable.
The App will be uninterrupted, error-free, or secure.
Your data will not be lost or damaged.
The App will meet your legal, regulatory, or compatibility requirements.

You use the App at your own risk. We are not liable for decisions made based on App content.

9. Indemnification

You agree to indemnify, defend, and hold harmless Hereditas, its affiliates, and employees from any claims, liabilities, damages, or expenses arising out of your use of the App, violation of these Terms, or infringement of any rights of a third party.

10. Limitation of Liability

To the extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of your use of the App.

Our total liability will not exceed the amount you paid (if any) for use of the App in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or misuse the App. You may terminate your account via in-app settings or by contacting us.

Upon termination, your license to use the App ends immediately. We may retain data as required by law.

12. DMCA and Copyright Complaints

If you believe content on Hereditas infringes your intellectual property rights, please contact us at info@hereditas.dev with a detailed description and supporting evidence. We respond to valid claims in accordance with applicable copyright laws (e.g., DMCA).

13. Privacy and Data Use

By using Hereditas, you agree to our Privacy Policy which governs how we collect and process personal data, including:

Your uploaded photos
Exact location where the photo was taken
Basic account information (e.g., email)

We do not store follow-up chatbot conversations. We use Supabase for secure hosting and may transfer data internationally. You have rights under laws like GDPR and CCPA. See our Privacy Policy for details.

14. Third-Party Links and Services

This App may reference or use services from third parties (e.g., OpenAI, Eleven Labs). We are not responsible for their content or practices. Use of such services is subject to their own terms and policies.

15. Changes to Terms and Services

We may update these Terms at any time. If changes are material, we will notify you via the App or email. Continued use of the App after updates means you accept the new Terms.

We may change or discontinue features of the App at any time.

16. Governing Law and Disputes

These Terms are governed by the laws of Spain, without regard to conflicts of law. Any disputes shall be resolved exclusively in the courts of Spain.

You agree to resolve disputes individually and not as part of a class action.

17. Severability

If any part of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
